Probate: Probate is a type of legal process usually necessary when a person dies. The legal term for a deceased person is decedent. The purpose of probate is to make sure the decedent’s property and belongings – collectively called the decedent’s estate - get properly inventoried, divided up and given to the correct people or organizations. Guardianship: A guardianship is a legal arrangement by which the court appoints a “guardian” to manage the affairs for an incapacitated person or a “ward.” There are two main types of guardianships. A Guardianship of the Person involves the ward’s personal and medical care, decisions regarding residence, and other related matters. A Guardianship of the Estate involves the ward’s money and property.
